By accessing or using SyBryan, you agree to these Terms. If you do not agree, please discontinue use of our Services immediately.

1. Overview

SyBryan provides AI-powered content creation services for local businesses. We capture or receive your media, generate social media content using artificial intelligence, and automatically post it to your connected platforms under your direction.

2. Eligibility

To use SyBryan, you must:

• Be at least 18 years old.
• Have the authority to enter into binding agreements on behalf of yourself or your business.
• Use our Services only for lawful purposes and in compliance with these Terms.

3. Accounts

When you create an account, you must provide accurate, current information and keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and all activity under your account. If you suspect unauthorized access, please contact support@sybryan.com immediately.

4. Services and Pricing

A. Initial Photoshoot

We offer on-site filming services at $20/hour, capturing visual content for your business (including photos and video footage).

B. Subscription Plans

After your initial photoshoot, you may subscribe starting at $99/month to access:

• AI-generated reels and posts.
• Automated scheduling and posting.
• Dashboard features.

Prices are subject to change with reasonable notice.

C. Payment Terms

• All payments are processed through secure third-party providers.
• Subscriptions renew automatically unless canceled before the next billing cycle.
• You may cancel at any time, but no refunds are issued for partial billing periods.

5. Use of AI and Media Content

By using our Services, you grant SyBryan a limited, non-exclusive license to:

• Store and process your media for the purpose of content generation, scheduling, and posting.
• Use anonymized data to improve AI models and service performance.

You retain full ownership of all original media. SyBryan does not claim any rights to your brand, likeness, or intellectual property beyond what's necessary to deliver our Services.

6. Acceptable Use

You agree not to use SyBryan to:

• Upload or generate content that is unlawful, defamatory, or infringing on others' rights.
• Misuse or attempt to hack our platform.
• Automate posting for third-party accounts without permission.

We reserve the right to suspend or terminate accounts that violate these terms.

7. Content Ownership

All AI-generated materials, including reels, captions, and post drafts, are owned by you once generated, provided your account is active and paid. You may download, repost, or reuse this content freely.

SyBryan retains rights to use anonymized, watermarked, or simulated examples of generated content for promotional or educational purposes only, unless you opt out by emailing support@sybryan.com.

8. Third-Party Integrations

SyBryan connects with third-party platforms such as Meta (Instagram/Facebook) and TikTok to post content on your behalf. You acknowledge that your use of these integrations is subject to each platform's own terms and privacy policies.

We are not responsible for downtime, errors, or data handling practices of these third-party platforms.

9. Service Availability

We strive for uninterrupted service but do not guarantee that the platform will always be available or error-free. We may temporarily suspend access for maintenance, updates, or system improvements.

10. Termination

You may cancel your subscription at any time through your account settings or by contacting support.

We reserve the right to suspend or terminate your access if you:

• Violate these Terms, or
• Engage in fraudulent or harmful activity.

Upon termination, your access to AI-generated content and features may be restricted.

11. Limitation of Liability

To the maximum extent permitted by law:

• SyBryan is not liable for any indirect, incidental, or consequential damages arising from the use of our Services.
• Our total liability to you will not exceed the amount paid to us in the 3 months preceding the claim.

We provide our Services "as is" and make no warranties, express or implied.

12. Indemnification

You agree to defend, indemnify, and hold harmless SyBryan and its affiliates from any claims, losses, or damages resulting from:

• Your use of our Services,
• Your violation of these Terms, or
• Content you upload, post, or create through SyBryan.

13. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any disputes will be resolved in the state or federal courts located in San Diego County, California.

14. Changes to These Terms

We may update or modify these Terms at any time. Updates take effect upon posting to this page. By continuing to use our Services, you agree to the updated Terms.
